Artist Consignment Agreement

This exhibition proposes a curated presentation of 2D and 3D works by Black artists whose practices embody narratives of cultural interconnectedness, resilience, and collective strength. Presented at a premier Black art fair, Collective Rhythms seeks to highlight how shared histories, traditions, and aesthetics continue to shape communal identity and unity. The works included will engage audiences in a multi-sensory dialogue that underscores how Black creativity, across time and geography, functions as a force of solidarity, healing, and forward vision.

In these current times—marked by global challenges, social unrest, cultural fragmentation, and the search for belonging—the theme of Collective Unity resonates now more than ever. At a moment when division often dominates headlines, the arts serve as a bridge: reminding us of our shared humanity, affirming the strength found in community, and offering visions of hope and possibility. Through the lens of Black artistic expression, this exhibition positions unity not as an abstract ideal, but as a lived practice of resilience, creativity, and connection.

The undersigned (“Artist”) hereby lends to Mahogany Gallery (“Gallery”) the artwork (“Work”) listed below (in “Artwork Inventory”) subject to the terms and conditions set forth in this loan agreement.

Loan Agreement
artist gives permission for mahogany gallery to represent and present artist’s work in the group exhibition at pigmented black fine art fair.

1. Consignment period between Artist and Gallery: 
Commencing upon signature of artist consignment agreement and ending one month after the end of the exhibition.

2. Gallery’s commission on artwork sales is 40%. Artist will be guaranteed 60% from art sales. The Artist will receive a check from Mahogany Gallery for the art sales within 60 days from the exhibition closing.

3. Artist is responsible for shipping/delivering the Work to the Gallery, including ensuring the Work for risk of loss or damage during shipment/delivery.

4. Artist is responsible for shipping/retrieving the Work from the Gallery, including ensuring the Work for risk of loss or damage during shipment/retrieval. 

5. Gallery will return any unsold Work to Artist within 60 days of the termination of the consignment period, unless other exhibition arrangements have been made and agreed upon between gallery and artist.

6. Gallery is not responsible for Work left after 90 days of termination of the consignment period, unless other arrangements have been made with Mahogany Gallery to hold the Work after the consignment period.

7. Artist may not remove Work from the premises during the consignment period.

8.  Work that is sold during the show will be marked as sold but remain on display for the duration of the show.  Work will be transferred to buyer at the completion of the show, upon full payment. 

II. Insurance
8. Mahogany Gallery will insure the Work for any loss or damage while the Work is in the Gallery’s possession. 

9. If Artist chooses to maintain his/her own insurance, Artist must instruct his/her broker to provide the Gallery with either a certificate of insurance with Mahogany Gallery and four leaf enterprises as listed as additional insureds.

III. marketing / promotion
artist and gallery are to both market and promote the artist, gallery and the art event on social media platforms and other marketing.

IV. Image Release
10. Gallery may photograph the Work to be used for promotions of the exhibition, for documentation and archive purposes, and for Gallery’s promotion of its exhibition programming. Gallery may share the images of artwork with press and other affiliates connected with the promotions of the exhibit and the Gallery in general. 

11. Title of the Work will be listed and Artist credited for the artwork when images of the artwork are used in any platform and format. 

12. Gallery and its affiliates may obtain pre-existing images of the Work from third parties if necessary to use in ways mentioned above. 

IV. Care
13. Gallery will exercise the same care with respect to the Work as it does with respect to comparable property of its own. The Work WILL NOT be unframed, removed from mats, mounts or bases unless permission is granted by the Artist. Gallery may add additional hardware to ensure the security of the Work during installation. The Gallery may replace faulty pre-existing screws, nails or hanging hardware to ensure the security of the Work being installed. Gallery WILL NOT make intrusive additions to the frame and Work, such as drilling, adding screws, nails, hangers, without the permission of the Artist. 

14. Gallery will not undertake any conservation or preservation treatment or otherwise alter the Work without prior consent of the Artist except in the case of an emergency requiring immediate intervention to prevent serious damage to the Work or any other work of art. In the event that the Work is altered in any way, Gallery will notify Artist immediately by telephone and subsequently in writing. The expense of conservation or preservation treatment, including but not limited to framing, will be the responsibility of the Artist, and can be deducted from Artist’s commission.
